“Constitution Pipeline’s sponsors remain committed to the project. Now that the FERC has issued an order on our request for rehearing, we are free to proceed with our petition to the D.C. Circuit Court of Appeals for review of the FERC’s decision (which denied our petition for a declaratory order given the long-held position that states waive their Clean Water Act Section 401 certification rights by failing to act within a reasonable amount of time on 401 applications). The Constitution project represents much-needed energy infrastructure designed to bring natural gas to a region of the country that this past winter experienced the highest natural gas prices in the world. We continue to believe in the importance of this critical infrastructure and that this project should be allowed to proceed with construction.”
